1. Introduction
Welcome to Tobiano, an independent horse management simulation game (“the Game”), developed and operated by Kanel Studios (“we,” “our,” or “us”).
By downloading, installing, or playing Tobiano on any platform (including Steam, Apple App Store, or Google Play), you agree to these Terms and Conditions (“Terms”).
If you do not agree, please do not install or play the Game.
2. Eligibility
You must be at least 13 years old to use the Game.
If you are under 18, you must have permission from a parent or guardian.
3. Accounts and Online Features
The Game requires an internet connection due to cloud saving and multiplayer features such as online horse sales, leaderboards, and multiplayer meetups.
You agree to:
- Provide accurate registration details.
- Keep your login credentials secure.
- Not share, sell, or trade your account.
We may suspend or terminate accounts involved in cheating, harassment, or rule violations.
4. Player Conduct
You agree not to:
- Harass, bully, or threaten other players.
- Use hate speech or offensive content.
- Exploit bugs, cheats, or automation tools.
- Use the Game for real-money trading or advertising.
Tobiano’s Discord server is an extension of the Game, and the same rules apply.
5. Virtual Items and Currency
Tobiano may include virtual items or currencies (e.g., “gold,” “tack,” or other unlockable content).
These have no real-world monetary value and cannot be exchanged for money.
We may change, reset, or remove virtual currencies, items, or rewards as needed for balancing or updates.
6. Game Systems and Progress
Tobiano features simulated systems such as:
- Horse Training: Includes temperaments, stress, and fitness impacts.
- Breeding: Features genetics, color traits, and conformation.
- Feeding and Management: Nutrient-based feeding with simulated realism.
Game features, mechanics, and data may evolve over time with updates. Progress may occasionally reset or change.
7. Intellectual Property
All game assets, artwork, mechanics, and code are owned by the Developer. Players retain ownership of their creative contributions (e.g., horse names, stable names), but grant the Developer permission to use them in-game and in promotional materials. You may not copy, modify, distribute, or reverse-engineer the Game or its assets.
8. Data Collection and Privacy
Tobiano collects minimal data necessary for account functionality and gameplay (see Privacy Policy for details).
No personal data is sold or shared with third parties.
By playing, you consent to data processing as described in the Privacy Policy.
9. Third-Party Services
Tobiano may connect with third-party services, including:
- Discord for community chat,
- Platform services (Steam, Apple, Google) for authentication and cloud saving.
Your use of those services is subject to their own terms and privacy policies.
10. Updates and Changes
We may update, modify, or discontinue parts of the Game without prior notice.
Major updates may alter features, gameplay balance, or saved data.
11. Disclaimer
Tobiano is provided “as is,” without warranties of any kind.
The Developer makes no guarantee of uninterrupted access or error-free operation. You use the Game at your own risk.
12. Limitation of Liability
To the fullest extent permitted by law, the Developer will not be liable for indirect, incidental, or consequential damages arising from your use of Tobiano.
13. Termination
We reserve the right to suspend or terminate your access if you violate these Terms. You may stop using the Game at any time by uninstalling it.
14. Governing Law
These Terms are governed by the laws of Norway.
Any disputes will be resolved in accordance with local legal procedures.
